With the Economy the way it is, where can a consumer go to get help?

The Bankruptcy rates are on the rise! Lately more and more people are filing for a Chapter 7 and Chapter 13 Bankruptcy. The difference between a Chapter 7 BK and a Chapter 13 BK is that the Chapter 7 wipes out the consumer’s debt and the Chapter 13 is a Repayment Plan over a period of time, usually 3 to 5 years.

Because of the economy these past several months, consumers are being laid off, with some consumers having difficulty paying their credit card debt, they do not know how to priortize their debt or the laws that govern credit, and debt. Consumers need to be educated on all of their options by Federal Laws!! This is where we at Simple Solutions Credit Consulting can help consumers unlike any other company! This is what usually happens: a consumer goes to a Bankruptcy attorney to ask if they should file for a Bankruptcy. Most Bankruptcy attornies will say “of course you do”! If a consumer goes to a Debt Consolidation place, then they will tell them, sure you need to use our services, because they want the consumer’s money. This can go on and on!

What consumers really need is a consultant who can tell them ALL OF THEIR OPTIONS, choices and rights under the Federal Laws such as: The Fair Credit Reporting Act, The Fair Debt Collections Practices Act, and The Fair Credit Billing Act. To us, it is only common sense! We all want to know this. Why wouldn’t we? If we did know all of our options, we can then make an educated decision on what is best for our own circumstance. Now that is empowerment!

Why do these companies only give us one choice, theirs? Because it is YOUR MONEY that they want!!! Most won’t even help clean up your credit reports let alone stop the harassing collection calls! Ok, maybe filing a Chapter 7 Bankruptcy can stop the calls but the Bankruptcy attornies won’t help clean up the credit reports or even tell you what you need to do to boost your credit scores. As for the Debt Consolidators, they can make BIG BUCKS either consolidating your credit card debt or receiving a “kick back” of money from the consumer’s creditors. Again, these types of companies still don’t improve consumers credit reports, raise their credit scores or stop the collection calls!

Bankruptcies up 30% in March 2008

According to an article from Credit and Collections World and SourceMedia, the statistics are in for bankrupcty filings in Federal Courts for a 12 month period ending March 31, 2008. Bankruptcies exceeded 900,000, according to statistics released Tuesday by the Administrative Office of the U.S. Courts.

The 901,927 bankruptcy cases filed represent a 30% increase over the 695,575 cases filed during the 12 months ended March 31, 2007.

Also according to Credit and Collections/SourceMedia, “after an initial drop in bankruptcy filings following the October 17, 2005, implementation date of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA), filings have risen gradually. Calendar year 2007 filings saw a 38% increase”.

The majority of bankruptcy filings are filings involving predominantly consumer debts, which totaled 871,186 over the 12 months ended March 31, up 29% from 673,615 filings in the period ended March 31, 2007.

Business bankruptcies rose 40% to 30,741, from 21,960 filings in the 12 months ended March 31, 2007.

For the 12-month period ending March 31, 2008, filings rose for all bankruptcy chapters, except for Chapter 12.

Chapter 7 filings rose 36% to 560,015, compared to the 413,294 Chapter 7 filings in the 12-month period ending March 31, 2007.

Chapter 13 filings rose 21% to 334,551 from 276,649 a year ago.

Chapter 11 filings rose 34% to 6,971 from 5,199 a year ago.

Chapter 12 filings fell 8% to 343 from 372 filings for the 12 months ended March 2007, the court system administration reported.

The 12-month total exceeding 900,000 filings is consistent with the expectation by the American Bankruptcy Institute that 2008 will see filings exceed 1 million.

“With the Credit Crunch going on, it is no wonder that the Bankruptcy filings are increasing. Who knows how long this Credit Crunch will continue. Foreclosures are at an all time high right now”, according to Valeri A. James, President, Simple Solutions Credit Consulting.
